These Terms of Service (“Terms”) govern your access to and use of the Sunulife website and mobile applications (collectively, the “Service”) operated by Sunulife Inc. (“Sunulife”, “we”, “us”). 1. Who We Are
Sunulife Inc. is a Canadian company operating a bilingual (English/French) digital media platform focused on Senegalese culture and the African diaspora. Contact: [email protected].
2. Eligibility
You must be at least 13 years old to use the Service. By agreeing to these Terms you represent that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials.
You must provide accurate and complete information when creating your account.
You may not share your account or allow others to access it on your behalf.
You must notify us immediately at [email protected] if you suspect unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the Service to:
Post, share, or transmit content that is unlawful, hateful, harassing, defamatory, obscene, or otherwise objectionable.
Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
Spam, phish, or send unsolicited commercial messages to other users.
Attempt to gain unauthorized access to any part of the Service or its infrastructure.
Scrape, crawl, or systematically collect data from the Service without our written permission.
Upload or distribute malware, viruses, or any other harmful code.
Violate any applicable law or regulation.
5. User Content
When you post comments, messages, questions, or other content (“User Content”) on the Service, you grant Sunulife a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with operating the Service. You retain ownership of your User Content.
You are solely responsible for any User Content you submit. Sunulife does not endorse and is not liable for any User Content posted by users.
6. Intellectual Property
All editorial content, design, logos, software, and technology on the Service are the property of Sunulife Inc. or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
7. Gold Membership & Subscriptions
Certain features require a paid Gold membership subscription.
Payments are processed securely via Stripe or PayPal. Sunulife does not store full payment card details.
Subscriptions renew automatically unless cancelled before the renewal date.
Refunds are handled on a case-by-case basis. Contact [email protected] for any billing disputes.
We reserve the right to change subscription pricing with reasonable advance notice.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Third-Party Links & Services
The Service may contain links to third-party websites or integrate third-party services (e.g., Google Analytics, reCAPTCHA, Stripe). Sunulife is not responsible for the content, privacy practices, or terms of those third parties.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Sunulife Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time by contacting us at [email protected].
13. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Ontario, Canada.
14. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by posting a notice on the Service or sending an email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
